Welcome to Besque. These Terms of Service govern your access to and use of the Besque website and your purchase of products through the website.
By accessing the website or purchasing products from Besque, you agree to these Terms.
1. Website Use
You agree to use the website only for lawful personal purposes.
You may not use the website to violate any applicable law, interfere with website operations, attempt unauthorized access, copy website content without authorization, or engage in fraudulent or abusive activity.
Users under eighteen (18) years of age are not permitted to use the website.
2. Product Information
Product information, descriptions, ingredients, prices, availability, promotions, and other website content may change without notice.
Besque reserves the right to correct errors, update information, limit quantities, or refuse or cancel orders when necessary.
3. Product and Health Disclaimer
Besque products are not intended to diagnose, treat, or prevent any disease or medical condition.
Customers should review product ingredients, precautions, warnings, and instructions before use.
For skincare products, Besque recommends conducting a patch test on a small area of skin before full use.
If you experience an adverse reaction, discontinue use and contact hello@besque.co.
4. Orders and Payment
When placing an order, customers must provide accurate and complete billing, shipping, and contact information.
By placing an order, you confirm that you are legally authorized to use the payment method provided.
Besque reserves the right to refuse or cancel an order for lawful reasons.
5. VIP Subscription Program
Customers who purchase recurring products through Besque's VIP subscription program authorize Besque to charge the selected payment method according to the subscription schedule.
The subscription automatically renews until cancelled.
A minimum of two consecutive billing cycles applies to VIP subscriptions.
Monthly subscriptions require at least 15 days' advance notice for cancellation under the current Terms of Service, while Besque's dedicated subscription policy separately states that cancellation requests should be made at least 72 hours before the next renewal to avoid that renewal. Customers should therefore cancel as early as possible through their account or by contacting vip@besque.co.
6. Intellectual Property
All content on the Besque website, including logos, photographs, product images, text, graphics, trademarks, designs, and other materials, is owned by or licensed to Besque and may not be copied, reproduced, distributed, or commercially used without permission.
7. Third-Party Websites
The Besque website may contain links to third-party websites.
Besque is not responsible for third-party websites, their content, privacy practices, products, services, or availability.
8. Disclaimer of Warranties
The website and its content are provided on an “as is” and “as available” basis to the extent permitted by applicable law.
Besque does not guarantee that the website will always be uninterrupted, secure, accurate, or error-free.
9. Limitation of Liability
To the extent permitted by applicable law, Besque and its affiliates, officers, employees, agents, suppliers, licensors, and service providers will not be liable for indirect, incidental, special, or consequential damages arising from use of the website or products.
Where a limitation of liability applies, Besque's Terms state that liability will not exceed the greater of the amount paid by the customer or $100.00, except where prohibited by law.
10. Arbitration and Class Action Waiver
These Terms contain a mandatory binding arbitration provision, jury trial waiver, and class action waiver.
Except where the Terms provide otherwise, disputes between you and Besque are to be resolved through individual binding arbitration.
Certain claims may still be brought in small-claims court or for appropriate equitable relief concerning intellectual property rights.
11. Governing Law
Except for California consumers, the Terms state that Delaware law governs the interpretation and enforcement of the Terms and arbitration provisions, without regard to conflict-of-law principles.
California consumers may be entitled to additional rights under applicable California law.
12. Changes to These Terms
Besque may modify these Terms from time to time.
Updated Terms become effective when posted on the website.
